Finding food and reading county-level data are free and always will be, for anyone. Neighborhood-level analysis, exports and reports require a paid plan matched to who you are.
This is a planning-level screening tool built from public data. It is not a substitute for verifying things yourself, and it must not be the sole basis for a funding, zoning, siting, eligibility or benefits decision.
There is no public API and no permission to scrape. Automated extraction without a written licence is unauthorized access, and section 6a sets out what it costs.
These terms are between you and InnovaOps LLC, a New Mexico limited liability company ("we," "us"). They govern your use of the New Mexico Food Pathways Intelligence Hub at nmfoodpathways.com and any related services (the "Service"). By using the Service or creating an account, you agree to them. If you are agreeing on behalf of an organization, you confirm you are authorized to bind that organization.
The Service compiles public data about food access in New Mexico, including retailer locations, food assistance programs, census and health statistics, and presents it as maps, scores, and analysis.
The free tier lets anyone find food pantries, SNAP retailers, WIC vendors, senior centers and meal sites, and read county-level food access data for all 33 New Mexico counties, without an account. We intend to keep this free.
Paid plans add neighborhood-level (census tract) analysis, exports, reports and programmatic access. Plans are matched to the type of organization you are, and are priced accordingly.
The Service is a planning-level screening tool. All scores, maps, counts, categories and suggestions are estimates derived from public data sources that may be incomplete, out of date, or wrong.
Parts of the Service, including portions of its analysis and interface, were developed with AI-assisted tooling. AI-assisted development can introduce errors, omissions or unintended bias that are not always obvious on review.

Subject to these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service according to your plan.
Finding food resources and reading county-level data are free to everyone, including organizations, with no account and no licence required. You may use that freely, including for work. We do not sell an individual or personal subscription; if you are one person looking something up, you should not be paying us.
What requires a licence is neighborhood-level (census tract) analysis, along with exports, batch reporting and anything built on top of the Service at scale.
Government, nonprofit, research and commercial plans permit use for the licensed organization's own purposes, by the number of seats purchased. They do not permit sublicensing, resale, or providing the Service's outputs to third parties as a standalone product.
A licence buys you access and support. It does not buy exclusivity, and it does not entitle you to have anyone else excluded. We intend to remove the paywall entirely if the platform becomes grant funded or sponsored, and we may do so at any time without that being a breach of these terms or a ground for refund. Your fees paid for the access and support you received while you had them.
If you are considering a licence on the understanding that others cannot obtain the same data, do not. Say so before you buy and we will tell you plainly that we cannot offer it.
Research plans are for non-commercial academic and research use. Published work drawing on the Service should cite it. Research plans do not permit commercial use.
Nonprofit and research pricing requires verification of your status, and we may ask for documentation. Misrepresenting your organization type to obtain lower pricing is a breach of these terms and entitles us to invoice the difference at list price.
Seats are for named people and must not be shared. If we determine in good faith that a licence has been used beyond the seats purchased, or by an organization other than the one licensed, we may invoice the applicable licence at our list price covering the period of that use, and/or suspend the account. We will contact you before doing so.
Authorization comes only from a written licence from us. The Service is protected by authentication, per-account rate limits, request-origin controls and usage metering. Those are access controls, not suggestions. Using an automated agent, script, crawler, headless browser, credential you were not issued, or any method that bypasses or defeats those controls is access without authorization, and continuing after we have told you to stop is access that knowingly exceeds authorization.
There is no public API. We do not offer programmatic access as a product. Any programmatic retrieval of data from the Service, other than through an interface we have licensed to you in writing, is unauthorized regardless of whether a technical measure was defeated to achieve it.
The harm caused by unauthorized extraction is real but difficult to measure precisely, because it displaces licence revenue, transfers the value of work we paid for, and can put stale or altered copies of food access information in front of people who rely on it. The parties therefore agree that the following is a reasonable pre-estimate of that harm and not a penalty:
These amounts are cumulative, and are in addition to, not instead of, any other remedy available to us.
Nothing in this agreement limits any right or remedy available to us by statute. Unauthorized access to or extraction from the Service may give rise to claims under, among others:
You agree that unauthorized extraction or redistribution would cause irreparable harm for which money damages alone are inadequate, and that we are entitled to seek injunctive relief without posting bond, in addition to damages.
We log every request to the Service, including the time, the account or key used, the data requested, the originating network address and the client identifier. You agree that these records are admissible evidence of access and of its extent. Where unauthorized use is reasonably suspected, you agree to preserve relevant records and to cooperate with a reasonable audit.
If you want programmatic access, or you are not certain whether an intended use is covered by your licence, ask us first. We would far rather licence you than pursue you, and we have never refused a reasonable request from an organization working on food access.
The Service, including its software, design, data models, scoring methodology, compilations and presentation, is owned by InnovaOps LLC.
What we do not claim. Facts are not copyrightable. The underlying source data comes largely from public bodies, including the US Census Bureau, USDA, CDC, HUD, the New Mexico Department of Health and the New Mexico Aging and Long-Term Services Department. We claim no ownership of those public datasets, and nothing in these terms restricts you from obtaining them directly from their sources. You are free to do so, and we will tell you where to look.
What we do claim. Under 17 U.S.C. § 101 and § 103, a compilation formed by selecting, coordinating and arranging pre-existing material is protectable to the extent of that original selection, coordination and arrangement, independently of the underlying facts. Our copyright therefore subsists in, among other things:
Copying the arrangement, the derived and scored values, or the expression of our methodology infringes that copyright even though the raw inputs are public. Reproducing our compilation is not the same act as gathering the underlying facts yourself.
The affordability lens adapts the ALICE® Household Survival Budget concept from United For ALICE, a United Way initiative. ALICE® is a registered trademark of United Way of Northern New Jersey. The Service uses ALICE's concept, not ALICE data.
Outputs you generate under a valid paid licence (reports, exports) may be used for your licensed purposes, including internally and in materials you produce, provided you do not present them as your own dataset or strip attribution where we require it.

We aim to keep the Service available and current, but we do not guarantee uninterrupted access. We may change, suspend or discontinue features. If we discontinue a paid feature you rely on, we will give reasonable notice and a pro-rated refund for the unused portion of your term.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, InnovaOps LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data or goodwill, arising out of or relating to your use of the Service, including decisions made or actions taken in reliance on it.
Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the fees you paid us in the twelve months before the claim arose, or (b) one hundred US dollars ($100).
Nothing in these terms excludes liability that cannot lawfully be excluded.
You agree to indemnify and hold harmless InnovaOps LLC from claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the Service.
We may suspend or terminate access for breach of these terms, for non-payment after notice, or where required by law. You may stop using the Service at any time. Sections that by their nature should survive termination, such as ownership, disclaimers, liability limits and any fees owed, do survive it.
Our Privacy Policy explains what we collect and how we handle it. It forms part of these terms.
We may update these terms. If a change materially affects your rights, we will give notice, by email to account holders or a notice on the Service, at least 30 days before it takes effect for you. Continuing to use the Service after that means you accept the updated terms.
These terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws rules. The state and federal courts located in New Mexico have exclusive jurisdiction over disputes arising from them.
